Terms & Usage Guide
English guidance based on the published Japanese terms. The Japanese terms prevail if there is any inconsistency.
Read the governing Japanese Terms
1. Definitions
“The Company” means 株式会社スマイルアカデミー. “The Site” means its free-material website, Muscle Plus. “Materials” means photographs, images, audio and other materials provided on the Site. “Official models” are models who have given the Company the necessary consent and permissions to appear in the Materials. “Users” means everyone who uses the Site or Materials.
2. Using the materials
- The Site mainly provides free photographs and audio featuring muscular and muscle models.
- Within these Terms and any conditions on the individual material page, you may download and use Materials free of charge for commercial or non-commercial purposes. No account is required.
- Cropping, editing, incorporating Materials into designs and tracing them for illustrations are allowed.
- For ordinary use, crediting the Site or model is not mandatory.
- Copyright and other rights are not waived. Users receive a non-exclusive licence to use Materials within these Terms. “Copyright-free” on this Site does not mean that copyright has been relinquished.
- Custom production, material requests, merchandising and collaboration projects may incur separate fees.
3. Models and likeness rights
- The Company has obtained consent for the use of official models’ likenesses in Materials; official models are indicated on material pages or elsewhere on the Site.
- Third parties appearing in collaborations may also have given the necessary consent. Follow any individual notes on the material page.
- Some festival, street or event Materials include people other than official models for whom individual model releases have not been obtained. Such cases are indicated on material pages.
- Individual conditions and notices apply in addition to these Terms.
4. Prohibited uses
You must not:
- Sell or redistribute Materials themselves, including original files, face-swapped Materials and cut-out parts.
- Sell products whose main value is the Material itself, such as posters, goods or collections centred on the photograph. Ask about corporate collaboration if you wish to merchandise Materials.
- Create a similar stock-material service using the Materials or supply them to an existing similar service.
- Make false statements about creators, rights holders or people appearing in the Materials.
- Infringe copyright, likeness, trademark or other rights of the Company, Site, models, photographers or third parties.
- Use Materials unlawfully, contrary to public order or morals, for defamation or discrimination, or in a way that seriously damages the reputation of the Company or models.
- Make unauthorised access, electronic attacks, excessive-load requests or otherwise disrupt operation of the Site.
- Use Materials for muscle-themed events, shops or projects similar to ALL OUT’s “Muscle Cafe”, a registered trademark of the Company.
- Use Materials in fitness gyms, personal-training gyms or similar competing services, because the Company operates BODY HACKERS LAB.
- Violate prohibitions or notices on individual material pages.
- Make other comparable uses that the Company reasonably considers inappropriate for rights protection or Site operation.
5. AI and machine learning
- AI training is prohibited in principle. Without prior permission, do not use Materials for training, additional training, fine-tuning, LoRA or similar supplementary models, training or evaluation datasets, or comparable AI/ML purposes.
- Bulk or ongoing collection by scraping, crawling or other methods for these purposes is also prohibited.
- AI models or image generation intended to reproduce or imitate a specific subject’s face, physical features, muscle shapes or poses require prior permission.
- Individual permission may be granted for research, development, corporate AI projects or dataset use after the Company reviews the purpose, Materials, scope, retention period and third-party provision. Conditions and fees may be agreed individually. Contact the Company in advance.
- Ordinary editing of individual images with AI-assisted software—such as cropping, background completion, colour correction or object removal—is not itself “AI training” under this rule and is allowed within the Terms. Training a reusable AI model with a Material or model, infringing third-party rights or other prohibited uses remain disallowed.
- Check an AI service’s terms and data policy yourself before uploading Materials. Settings that allow the provider to use uploads for training may violate the training prohibition.
6. Commercial use on YouTube
Commercial use of photographs or audio on YouTube must also comply with any separately designated rules, including derivative-work guidelines for the official Muscle Plus plus YouTube channel, where applicable.
7. Provision of the Site and Materials
- The Company may add, change, suspend or remove Materials, or change or interrupt all or part of the Site.
- The Company does not guarantee suitability for a particular purpose, completeness, accuracy or continued availability of every Material.
- The Company does not guarantee the content or safety of external links, third-party services or advertisements.
8. Disclaimer and liability
- You use the Site and Materials at your own responsibility.
- To the extent permitted by law, the Company is not liable for damage arising from use of Materials or use or suspension of the Site.
- If the Company is liable, except in cases of intent or gross negligence, liability is limited to ordinary and direct damage to the extent permitted by law.
- Check rights for your intended use yourself where Materials contain non-official-model subjects or individual notices.
9. Changes to the Terms
The Company may change these Terms as needed in accordance with law. Revised Terms apply when published on the Site or at a separately specified time. Continued use of the Site or Materials after a change is deemed agreement to the revised Terms.
10. Governing law and jurisdiction
Japanese law governs these Terms. For disputes concerning the Terms, Site or Materials, the court with jurisdiction over the Company’s location has jurisdiction to the extent permitted by law.
11. Other provisions
If any provision is found invalid or unenforceable under law, the other provisions remain valid.
